Kalam Terms of Use

Introduction

These terms of use (the "Terms") govern your use of the Kalam app (the "App"), a Quranic audio stories application. By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

Use of the App

You may use the App only for lawful purposes and in accordance with these Terms. You may not use the App:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit any unsolicited or unauthorized advertising or promotional materials
• To transmit any material that contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that are intended to damage, interfere with, or surreptitiously intercept or expropriate any system, data, or personal information
• To attempt to gain unauthorized access to, interfere with, or disrupt any servers, networks, or other infrastructure

In-App Purchases and Subscriptions

The App offers in-app purchases and subscription options to access premium content and features. By making an in-app purchase or subscribing, you agree to the following terms:

• Purchases and subscriptions are processed through your platform's app store (such as Apple App Store or Google Play Store)
• Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period
• Subscriptions and purchases do not guarantee lifetime access to content or features
• Access to premium content and features is provided only while the service is supported
• Prices for subscriptions and in-app purchases may change at any time
• We do not guarantee 24/7 uptime or availability of the service
• Refunds for purchases or subscriptions must be requested through your platform's app store according to their policies

Service Availability

While we strive to provide uninterrupted access to our App, we do not guarantee continuous, uninterrupted, or secure access to the App or any related services. The operation of the App may be interfered with by numerous factors outside of our control, including but not limited to telecommunications network disruptions, system maintenance, and technical issues. We do not guarantee 24/7 availability or uptime of the service.

Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Kalam or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the App for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your Web browser for display enhancement purposes

Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. Kalam does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App or the servers that make it available are free of viruses or other harmful components.

Limitation of Liability

In no event will Kalam or its directors, employees, agents, or affiliates be liable for any direct, indirect, special, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the App or the information contained therein.

Refund Policy

All purchases and subscriptions made through the App are processed by your platform's app store (such as Apple App Store or Google Play Store). Refund requests must be submitted directly to the respective app store according to their refund policies. We do not process refunds directly and have no control over the app stores' refund decisions.

Indemnification

You agree to defend, indemnify, and hold harmless Kalam and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees).
